Most personal injury attorneys offer a free initial consultation — a meeting where the attorney evaluates whether your case has merit and you evaluate whether to hire them. There is no obligation to hire after a consultation.
What the Attorney Will Ask
- How the accident happened and who you believe was at fault
- What injuries you sustained and what treatment you have received
- Whether you have spoken with the other party's insurance company
- Whether you have documentation (photos, medical records, accident reports)
- When the incident occurred (to evaluate statute of limitations)
What to Bring
- Photos of the accident scene and your injuries
- Police or incident reports if available
- Medical records and bills received so far
- Insurance information (yours and the other party's)
- Documentation of lost wages if applicable
- Any written communication with insurance companies
What You Should Ask
- What is your initial assessment of the strength of my case?
- What is your fee structure?
- How long do cases like mine typically take?
- What challenges do you anticipate?
- Who will handle my case day to day?
After the Consultation
The attorney will either accept or decline to represent you. If you decide to move forward, you will sign a retainer agreement outlining the fee arrangement. You are not obligated to hire the first attorney you consult — it is reasonable to meet with two or three before deciding.
